The STAX. CORE GIVEAWAY will begin at 12:00:00 p.m. Australian Eastern Daylight Time (“AEDT”) on Wednesday 4TH January 2023 and will end at 9:00:00 a.m. AEDT on 27th January 2023 (Promotion Period).
By participating in the Promotion, you will be deemed to have reviewed, accepted, and agreed to these terms, and accept the decisions made by STAX. as final and binding in all respects. No prize will be awarded under the Promotion unless, in STAX.'s sole discretion, the relevant prize winner has complied in all respects with the requirements set out in these terms.
This Promotion is not sponsored, endorsed, or administered by, or associated with any flight and accommodation providers, or Instagram, Facebook, Snapchat, Pinterest, TikTok, Twitter or any other channel or medium in which it is promoted.
The promotion is only open to residents of Australia who are 18 years of age or older.
STAX.’s parents, subsidiaries, affiliates, distributors, retailers, sales representatives, advertising, and promotion agencies, and each of their respective officers, directors, and employees, as well as the household members (whether or not related) and immediate family members (parents, step- parents, legal guardians, children, stepchildren, siblings, or spouses) of each are ineligible to enter the Promotion or to win the prize.
This Promotion is subject to all applicable Commonwealth and state laws and regulations in Australia and is void where prohibited or restricted by law.

Only one entry per participant is permitted. Multiple entries including from the same device or ISP will be treated as one entry. STAX. may ignore entries submitted by script, macro or other automated or mechanical means, entries by any means which in the opinion of STAX. subverts the entry process, entries mechanically reproduced, or otherwise where STAX. believes there has been manipulation in any way, including via bots and equivalent, and is not obliged to provide reasons or evidence to any participants in relation to the removal, omissions, or treatment of entries in the Promotion.
Proof of submitting an entry does not constitute proof of receipt of such entry by STAX.
The winning participant will be determined by STAX. at 11:00:00 a.m. AEDT on WEDNESDAY 27th JANUARY 2023 at Unit 4, 1801 Botany Road Banksmeadow NSW 2019. The winning participant will be randomly generated online from a pool of all eligible participants.
All decisions by STAX. are final.
There will only be [one] prize in the Promotion.
The prize is valued up to $2,999 AUD and will consist of:
1 Core STAX. Pack valued at $1000AUD & 1 Luxury Fitness Bike
The Promoter is STAX. Pty Ltd (ACN 622 114 952) of [Unit 4, 1801 Botany Road Banksmeadow 2019] (STAX.).
Winner will receive pieces up to the value of $1000AUD from STAX. Core Collection: Dropping January 27th, 2023, and 1 luxury fitness bike as determined by STAX.
The prize is not redeemable for cash or any other method of payment and is not transferrable. The prize will only be awarded for the dates set out above and STAX. will not be responsible or liable to replace or provide any part of the prize that is redeemed by the winning participants on the dates set out above, and any part of the prize that is not redeemed by the winning participant will be deemed forfeited.
If the Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of STAX., including but not limited to technical difficulties, unauthorised intervention, or fraud, STAX. reserves the right, in its sole discretion, to the fullest extent permitted by law:
The potential prize winner will be notified by phone and by email at the phone number and email address supplied on the Entry Form on or about [January 27th 2023) (Notification Date).
The last name, initial of the first name and postcode of each winner of a prize the value of which is over $250 must (except for any winner who has requested that their name and postcode not be so published) be published within 30 days of the drawing of the lottery on the giveaway terms and conditions at https://stax.com.au/pages/core-giveaway
or, if there is more than 1 drawing of the lottery, the final drawing of the lottery in the location specified in the terms and conditions of the lottery.
If STAX. does not receive confirmation from the winning participant accepting the prize within 30 days, the prize will be forfeited and will be drawn again. The redraw will occur on or about 11:00:00 a.m. AEDT on Monday 27th February 2023 or the next closest business date at Unit 4, 1801 Botany Road Banksmeadow NSW 2019. The winning participant will be randomly generated online from a pool of all eligible participants.
The winning participant is subject to verification by STAX. STAX. reserves the right to disqualify the winning participant that STAX. has reason to believe has breached these terms, tampered with the entry process or engaged in any unlawful or other improper misconduct that jeopardised fair and proper conduct of the Promotion.
Except where prohibited by law, participation in the Promotion constitutes the winning participation's consent to STAX.’s use of the winning participant’s name, image, likeness, photograph, voice, and city and state of residence for promotional purposes in any media, worldwide, irrevocably and in perpetuity without further notice, payment, or consideration to the winning participant.
STAX. will handle information provided by the participants in accordance with its Privacy Policy [https://stax.com.au/policies/privacy-policy] and applicable laws.
STAX. collects personal information (“PI”) in order to conduct the Promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers and prize suppliers.

STAX. may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant.
The Privacy Policy contains information about how entrants may opt out, access, update or correct their PI.
All entries become the property of STAX.
Except for any liability that cannot by law be excluded, STAX. (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury, death or any loss or damage (including loss of opportunity), whether direct, indirect, special or consequential, arising in any way out of this Promotion including in relation to:
(a) any late, lost, damaged, misdirected, incorrect or incomplete entries;
(b) any typographical errors in the offer or administration of the Promotion, including, but not limited to, errors in any Promotion-related materials, including all advertising for the Promotion, these terms and the distribution of a prize;
(c) incorrect or inaccurate entry information, or for any faulty or failed electronic data t ransmissions;
(d) any unauthorised access to, or theft, destruction or alteration of entries at any point in the operation of this Promotion;
(e) any technical malfunction, failure, error, omission, interruption, deletion, defect, delay in operation or communications line failure, regardless of cause, with regard to any equipment, systems, networks, lines, satellites, servers, camera, computers or providers utilised in any aspect of the operation of the Promotion;
(f) inaccessibility or unavailability of any network or wireless service, the Internet or website or any combination thereof;
(g) suspended or discontinued Internet, wireless or landline phone service; or
(h) any injury or damage to entrant’s or to any other person’s computer or mobile device which may be related to or resulting from any attempt to participate in the Promotion or download of any materials in the Promotion.
Each participant acknowledges and agrees that STAX. relies on the product risk controls of the relevant provider for each part of the prize and that participation in the prize has an obvious risk of harm and the participants are aware of this risk of harm.
The maximum aggregate liability of STAX. in relation to and arising from these terms and the Promotion is the maximum value of the prize.
STAX. shall not have any further liability to any participant in connection with the Promotion.
The Promotion is subject to the laws of New South Wales, Australia. Entrants consent to the jurisdiction and venue of the courts located in New South Wales, Australia for the resolution of any disputes, claims and causes of action arising out of or relating to this Promotion or the prize.
